The West Virginia eighth-grader who was suspended and arrested in late April after he refused to remove a t-shirt supporting the National Rifle Association appeared in court this week and was formally charged with obstructing an officer.
As CBS affiliate WTRF reports, 14-year-old Jared Marcum now faces a $500 fine and a maximum of one year in prison.
The boy’s father, Allen Lardieri, is not pleased.
“Me, I’m more of a fighter and so is Jared and eventually we’re going to get through this,” Lardieri told WTRF.  “I don’t think it should have ever gotten this far.”
“Every aspect of this is just totally wrong,” Lardieri added.  “He has no background of anything criminal up until now and it just seems like nobody wants to admit they’re wrong.”
Officials at Logan Middle School in Logan County, West Va. maintain that Marcum, who has since completed eighth grade, was suspended for one day because he caused a disruption after a teacher asked him to remove a shirt emblazoned with a hunting rifle and the statement “protect your right.”
“She said, ‘Are you supposed to wear that in school?’” Marcum had previously explained in an interview with local station, WOWK-TV. “I said, ‘I don’t see why I shouldn’t.’”

"Eighth Grader Could Face Year in Jail for Wearing NRA T-Shirt"

A West Virginia judge has ruled that an eighth grader who was arrested after wearing an NRA t-shirt to school will stand trial for obstructing an officer, a crime that can carry up to a year in jail and $500 fine.
Jared Marcum, 14, was charged last week after wearing the shirt to school in April. The shirt included the logo of the National Rifle Association, an image of a rifle, and words “protect your right.”
Jared was asked to remove the shirt or turn it inside out by a secretary and then a teacher at Logan Middle School in Logan, W.Va. When he refused to do so he was brought to the principal, who called police.
The boy said that when police arrived at the school, they told him “sit down and shut up” and threatened to charge him with making terroristic threats when he tried to explain his side of the story.
Jared said he was detained in a room with the principal and two officers. He was unarmed and presented no threat to the officers or students, according to his lawyer.
“I never thought it would go this far because, honestly, I don’t see a problem with this,” the boy told WOWK-TV in April. “There shouldn’t be a problem with this.”
He received just one day of suspension from school.
Jared’s attorney today filed a motion to dismiss the case.  A hearing on that motion will take place on July 11.
The law allows persons under arrest to question police and tell their side of a story, said his lawyer, Ben White.
“Case law says you can question police and you can talk to  police – you just can’t use foul language, or insult them,” said White.

  4. how dumb is that being arrested for wearing a t-shirt. Bloody Hell! Dismiss the case not even worth it being in court, wasting time over a t-shirt about protecting yourself with rifles. As if hes walking around with a concealed weapon now that's what you got a look out for. Freedom of speech!!!!!

  5. Your missing the point. The point is that this child (an American citizen) made a statement about an American having the "right to bear arms" and the "right to freedom of speech". These are values that this country was founded on and have made the United States great. No one has the right to infringe upon these, least of all publice servant's like teachers or police. This child broke no laws and did not infringe on anyone else's rights. His were clearly violated though. Oh and as an after thought: people who say he is a clown who will shoot up a school or public place ass-u-me this kid is unstable. This is a very prejudice statement based out of fear and ingorance. That would be like me saying that you must not be an American if you feel that way. This kids rights were violated and you want to attack him. Really! As I understand it ...he was not arrested for the tee shirt but for refusing to obey the law of the school ... he was told to turn his shirt inside out ...if he had done that...he would not have gotten the police called on him ...we all have to obey dress codes...I find nothing wrong with his shirt ...but the school did ...he should learn to obey the rules

In America, people like you are the reason we are slowing becoming slaves in a police state while the corrupt corporate money is running our government tells you to "obey our rules and we wont have any problems". The shirt said stand up for your rights. Even in in a public school dress code people should not be legally allowed to ban this type of statement on a t-shirt (if t-shirts with statements are already allowed) , and he was standing up for an unjust law. Unlucky for him, the unjust LAWS continue with the police, judges, and court systems as well. If a law was passed that effectively banned you from having children (obviously it would be called the "save us from terrorism act" or something of that nature), would you sit back and obey the rules, or stand up for them.

It would have made no difference if he was hearing an anti NRA shirt It was rules he broke. Those saying its against his freedom of speech are as stupid as those suggesting he's a potential murderer. Wise up and treat him as he is......a rule breaker who obstructing police.

    1. answer this... does it make sense to you that POLICE officers are getting involved in SCHOOL dress code issues??

      NO it does not. The entire issue is that there was a picture of a gun on the shirt. That violates the ZERO TOLERANCE policy of schools.

      that said, the bigger issue is still the fact that the police can put a CHILD in jail for wearing a freaking tshirt. SO WHAT IF HE BROKE THE DRESS CODE... do you really think that CHILDREN should be jailed for breaking a school's dress code policy. REALLY?!

  13. It seems every day more and more of our freedoms are taken away from us. Now here is my only question does the school have a dress code. MY son's school has a rule that states no t-shirts/jackets with pictures of guns on them. If he broke the dress code rule, then suspend him but don't arrest him.
